AUDIOPOOL, Inc. ("AUDIOPOOL," "Company," "we," "us," or "our") respects your privacy and is committed to protecting personal information through the practices described in this Privacy Policy.

This Privacy Policy describes how we collect, use, maintain, protect, disclose, and otherwise process information when you visit or use https://www.audiopool.io/, the AUDIOPOOL application, Artist Studio, fan-powered charts, Track pages, Artist and user profiles, Download features, reward features, sharing features, blockchain-enabled features, and related products and services (collectively, the "Services").

AUDIOPOOL is a music discovery platform. The Services are designed to make certain participation visible, including profile information, Playing, Boosting, Sharing, Download activity, chart participation, reward activity, and certain wallet-linked interactions. Some participation features use public blockchain infrastructure. Related blockchain records may be publicly visible, irreversible, and technically impossible for AUDIOPOOL to delete or change.

This Privacy Policy should be read together with our Terms of Use and, for Artists who upload Tracks, the AUDIOPOOL Artist Upload License Agreement. Capitalized terms not defined here have the meanings given in those agreements.

This Privacy Policy applies to information we collect:

• on or through the Services;
• in email and other electronic communications between you and AUDIOPOOL;
• when you create or use an account, use Artist Studio, upload Artist Content, Play, Boost, Share, Download, participate in charts or rewards, or interact with Industry Opportunities; and
• through your other interactions with us in connection with the Services.

This Privacy Policy does not apply to information collected independently by third parties through websites, applications, services, or content that may link to or be accessible from the Services, except where this Privacy Policy expressly describes our receipt or disclosure of that information.

Please read this Privacy Policy carefully. A valid, verified, and monitored email address is a condition of creating and maintaining an AUDIOPOOL account because electronic communications are necessary to deliver chart visibility, rewards, Industry Opportunities, and other participation features. Where applicable law requires consent for a particular type of processing that is not necessary to provide the Services, we will request that consent separately or through a clear notice presented at the relevant time. You may choose not to provide certain information, although this may prevent you from creating an account or using some features of the Services.

Children Under 18

The Services are not intended for children under 18 years of age. No one under 18 may create an account, upload content, or provide personal information through the Services.

We do not knowingly collect personal information from children under 18. If we learn that we have collected personal information from a child under 18, we will take reasonable steps to delete it, subject to legal obligations and technical limitations, including the limitations of public blockchain records. Information We Collect About You

We may collect the following categories of information from and about users of the Services.

1) Identity and Contact Information

• name or legal name;
• email address;
• phone number and mailing address, if collected;
• date of birth or age-confirmation information, if collected;
• tax, payment, or payout information where required for reward or opportunity fulfillment; and
• government-issued identification or verification information where required for identity verification, fraud prevention, sanctions screening, KYC, tax, legal, or compliance purposes.

2) Account, Profile, and Preference Information

• username, user handle, and account identifiers;
• profile image, banner image, biography, links, and link-in-bio content;
• Artist role, Fan role, approval or invitation status, and Artist Studio access status;
• communication preferences, consent choices, unsubscribe status, and suppression-list status;
• account settings, language, territory, and other preferences; and
• account creation, verification, suspension, restriction, and deletion records.

3) Artist Content, Rights, and Upload Information

If you are an Artist or submit content, we may collect:

• Track files, releases, artwork, titles, descriptions, credits, metadata, profile materials, images, text, and links;
• upload dates, publication status, availability, removal requests, and moderation records;
• human-created or AI-generated classification and related declarations;
• master, publishing, composition, sample, featured-artist, producer, performer, artwork, and other rights information you provide;
• Download authorization and settings, including whether a Track is available as a free or Boost-gated Download;
• Artist representations, warranties, confirmations, and acceptance records for the Artist Upload License Agreement;
• information submitted in rights, infringement, takedown, support, onboarding, and dispute communications; and
• information relating to chart eligibility, rewards, recognition, and Industry Opportunity consideration.

4) Music Discovery and Participation Information

We collect information about how you discover and support music, which may include:

• Tracks and pages viewed;
• Play activity, including Track identifiers, timestamps, playback duration, completion, and qualified-listen information;
• Boosting and Unboosting activity, including amounts, timestamps, wallet addresses, and Track associations;
• Sharing activity, referral links, clicks, attribution, qualified listens, signups, and other outcomes generated from Shares;
• Download activity, including Download eligibility, support actions used to unlock a Download, file delivery, Download timestamps, limits, and technical records;
• chart position, chart movement, chart snapshots, eligibility, integrity review, and related participation signals;
• Fan Leaderboard activity, discovery-impact information, early-support records, and reward eligibility;
• reward, recognition, mission, campaign, and Industry Opportunity participation; and
• fraud, botting, multi-accounting, manipulation, anomaly, and integrity-review signals.

5) Wallet and Onchain Information

Boost is AUDIOPOOL's onchain digital vote used within the Services to support Tracks, participate in chart activity, and access certain reward, recognition, Download, or opportunity-related features. We may collect:

• embedded and connected wallet addresses;
• wallet-related identifiers associated with your account;
• Boosting, Unboosting, reward, snapshot, and other smart-contract activity;
• Track identifiers, smart-contract addresses, transaction hashes, block data, timestamps, and related onchain metadata; and
• other public blockchain activity associated with your use of the Services.

Some wallet and onchain information is public by design and may be permanently available on public blockchain networks.

6) Reward, Redemption, and Industry Opportunity Information

• eligibility, entry, selection, result, and fulfillment information;
• reward openings, cooldowns, limits, and participation timestamps where relevant;
• communications and decisions relating to a label review, feature, release, placement, campaign, sponsorship, booking, media opportunity, playlist, catalogue placement, licensing opportunity, or other Industry Opportunity;
• information needed to introduce an Artist to an Industry Partner or administer an opportunity;
• shipping, payment, tax, identity, or contact information needed for fulfillment; and
• records of acceptance, decline, completion, dispute, or cancellation.

7) Communications and Email Information

• emails, support messages, feedback, survey responses, and correspondence with us;
• delivery, bounce, open, click, unsubscribe, and preference information where permitted by law;
• the version and wording of notices or consent choices shown to you;
• the date, time, source, and method of any communication preference or consent choice; and
• records needed to honor objections, opt-outs, and unsubscribe requests.

8) Usage, Device, and Technical Information

• IP address and approximate location inferred from IP address;
• browser type and version, operating system, device type, and device identifiers;
• referring URLs, pages or screens viewed, clicks, session activity, dates and times of access;
• authentication, security, error, performance, diagnostic, and server logs; and
• cookie identifiers and similar technology data.

9) Information From Third Parties

We may receive information from third parties that support or interact with the Services, including:

• authentication and wallet infrastructure providers, including Dynamic or similar providers;
• blockchain networks and blockchain-data providers;
• hosting, storage, content-delivery, analytics, and communications providers;
• identity verification, compliance, fraud-prevention, payment, payout, and tax providers;
• social media, login, referral, and sharing services, if enabled;
• Artists, Industry Partners, sponsors, labels, promoters, media companies, platforms, fulfillment providers, and other parties involved in rewards or Industry Opportunities; and
• publicly available sources and information lawfully provided by other users.

How We Collect Information

Directly From You

We collect information when you create an account, set up a profile, request or receive Artist access, use Artist Studio, upload or manage Artist Content, authorize Downloads, Play, Boost, Share, Download, participate in charts, rewards, campaigns, or Industry Opportunities, contact support, submit a report, respond to a survey, or provide identity, payment, tax, or fulfillment information.

Automatically

We may collect information automatically through cookies, pixels, local storage, SDKs, server logs, analytics tools, security tools, and similar technologies when you use the Services or interact with our emails.

From Third Parties

We may receive information from providers and partners that support authentication, wallets, hosting, analytics, communications, payments, compliance, fraud prevention, rewards, downloads, fulfillment, referrals, and Industry Opportunities.

From Public Blockchain Networks

We may read public blockchain records and associate wallet addresses, transactions, smart-contract events, and related onchain information with accounts, Tracks, chart activity, rewards, and other use of the Services.

Cookies and Similar Technologies

We and our service providers may use cookies and similar technologies to operate, secure, measure, and improve the Services. These technologies may be used to:

• keep you signed in and maintain sessions;
• remember settings and preferences;
• protect accounts and prevent fraud or abuse;
• measure performance, usage, and feature effectiveness;
• support playback, sharing, attribution, Download, chart, and reward functionality;
• measure delivery and engagement with communications where permitted by law; and
• diagnose errors and improve the Services.

Where required by applicable law, we will request consent before using non-essential cookies or similar technologies. You may be able to manage choices through a cookie banner, preference center, browser settings, or device settings. Blocking certain technologies may affect the operation of the Services.

How We Use Your Information

We may use personal information for the following purposes.

To Provide and Operate the Services

• create, verify, administer, and secure accounts;
• provide profiles, Artist Studio, Track pages, playback, Boosting, Sharing, Downloads, charts, Fan Leaderboards, rewards, and related features;
• host, store, encode, format, transmit, display, perform, distribute, and make Artist Content available as authorized under the Artist Upload License Agreement;
• provide Download files to eligible users and enforce Download eligibility, limits, usage terms, and territorial rules;
• process chart participation, snapshots, rankings, integrity checks, rewards, and recognition;
• provide reporting, analytics, support, and operational information to Artists and users; and
• maintain historical chart records, audit logs, compliance records, and prior operational records where reasonably necessary.

To Support Artists, Rights Management, and Content Integrity

• review Artist approval, invitations, access, and uploads;
• verify or assess metadata, rights information, classifications, and permissions;
• moderate, restrict, remove, or restore content;
• process infringement, takedown, rights, and dispute reports;
• investigate suspected unauthorized uploads, Downloads, redistribution, manipulation, or abuse; and
• enforce the Terms of Use, Artist Upload License Agreement, Chart Rules, Content Standards, and program rules.

To Operate Music Discovery, Charts, and Downloads

• organize and display Tracks based on valid participation under the Chart Rules;
• measure Playing, Boosting, Sharing, Downloading, and other recognized activity;
• calculate chart position, movement, momentum, eligibility, and related signals;
• show public chart results, chart highlights, weekly results, and historical chart information;
• determine whether a user satisfies Download requirements and deliver authorized files;
• detect and prevent artificial activity, botting, multi-accounting, manipulation, unauthorized redistribution, and other abuse; and
• improve discovery, recommendation, chart, Download, and integrity systems.

To Administer Rewards and Industry Opportunities

• determine eligibility and administer rewards, recognition, missions, campaigns, and benefits;
• identify Artists or Tracks that may be relevant to an Industry Opportunity;
• present Artist, Track, chart, participation, and contact information to an Industry Partner where necessary to evaluate or administer an opportunity;
• make introductions requested or reasonably expected as part of the Services;
• coordinate fulfillment, support, tax, payment, compliance, and fraud-prevention requirements; and
• communicate decisions, availability, conditions, and outcomes.

AUDIOPOOL connects Artists and Tracks with potential Industry Opportunities but does not guarantee any review, selection, signing, placement, campaign, booking, or other outcome.

To Communicate With You

We may use your email address and other contact information for the following communications:

• account verification, login, security, support, moderation, rights, legal, and operational notices;
• Track, Artist Studio, Download, chart, reward, and Industry Opportunity information connected with your account or activity;
• changes to the Services, Terms of Use, Artist Upload License Agreement, Privacy Policy, Chart Rules, or program terms;
• chart results and highlights relevant to your participation; rewards you have earned or may qualify for; Industry Opportunities available or offered through AUDIOPOOL; activity involving your account, profile, or Tracks; and other information reasonably necessary to administer your participation in the Services; and
• requests for information or action reasonably necessary to operate, secure, evaluate, or improve the Services.

AUDIOPOOL connects Artists, Fans, DJs, curators, and other users with chart visibility, rewards, recognition, and Industry Opportunities. The ability to contact account holders is necessary to provide and administer these features. When you create and maintain an AUDIOPOOL account, you must provide a valid, verified, and monitored email address. We use that address to communicate with you about your account and participation, including relevant chart activity, rewards, Industry Opportunities, Artist Studio, Tracks, Downloads, moderation, rights, security, legal, and operational matters. These essential participation communications form part of the Services and are not an optional newsletter subscription.

AUDIOPOOL does not use the mandatory essential-communications stream to send unrelated promotional emails. We do not sell your email address to Artists, Industry Partners, sponsors, or other third parties, and we do not permit third parties to send advertising directly to you through that stream.

To Improve, Personalize, and Secure the Services

• understand how people use the Services and which features are effective;
• personalize discovery, communications, and user experience where permitted by law;
• develop, test, debug, and improve products and features;
• prevent fraud, unauthorized access, manipulation, harmful conduct, and security incidents;
• maintain network, information-system, wallet, and platform integrity; and
• generate aggregated, statistical, and de-identified insights.

For Legal and Business Purposes

• comply with laws, regulations, court orders, legal process, tax rules, sanctions requirements, and lawful government requests;
• establish, exercise, or defend legal claims;
• protect the rights, property, safety, reputation, and operation of AUDIOPOOL, users, Artists, Industry Partners, and others;
• conduct audits, due diligence, corporate governance, accounting, and recordkeeping; and
• support a merger, financing, acquisition, reorganization, asset sale, or similar corporate transaction.

Lawful Bases for Processing in the UK and EEA

Where UK or EEA data protection law applies, we rely on one or more of the following lawful bases, depending on the activity:

• Contract: processing necessary to create, verify, administer, and secure your account; provide Artist Studio, Tracks, playback, Boosting, Sharing, Downloads, charts, rewards, and related features; communicate information necessary to administer your account and participation; notify you of relevant chart activity, rewards, and Industry Opportunities; and fulfill requests and obligations under the Terms of Use and Artist Upload License Agreement;
• Legitimate interests: operating and improving the Services; maintaining effective communication with users; supporting music discovery, chart visibility, rewards, and Industry Opportunities; ensuring that Artists and other users can be contacted where reasonably necessary to provide the Services; protecting partner confidence; preventing fraud and manipulation; maintaining chart and network integrity; understanding use; and conducting ordinary business operations, balanced against your rights and interests;
• Consent: where required for non-essential cookies, optional profiling, unrelated advertising, optional third-party promotions, or another specific activity that is not necessary to provide the Services. You may withdraw consent at any time without affecting earlier lawful processing;
• Legal obligation: processing required for tax, accounting, sanctions, regulatory, law-enforcement, or other legal obligations; and
• Legal claims and substantial public interests: where applicable law permits processing for fraud prevention, legal claims, or other recognized interests.

Electronic-marketing and cookie rules may impose requirements in addition to data protection law. We will apply the consent, notice, opt-out, and recordkeeping requirements that apply in the relevant jurisdiction.

Public Visibility and Chart Participation

AUDIOPOOL is designed to make music discovery and participation visible. Information that may be publicly displayed through the Services includes:

• username or handle;
• public profile image, biography, links, and other public profile content;
• Artist name, Track titles, artwork, metadata, credits, classifications, and Track availability;
• chart position, chart movement, chart history, results, highlights, and recognition;
• Boosting, support, Download, Sharing, reward, or other participation details where displayed by the Services;
• wallet address and wallet-linked activity; and
• Fan Leaderboard position, discovery-impact information, and early-support records where enabled.

Public participation information may be visible to Artists, Fans, Industry Partners, sponsors, and other visitors. Public profile information may be linked to a wallet address within the Services. Non-public information such as your email address, legal name, phone number, mailing address, tax information, and identity-verification documents is not used as public chart information and is not disclosed to Artists or sponsors by default.

Artist and Industry Partner Visibility

Artists may see public or platform-visible information about people supporting their Tracks, such as usernames, profiles, wallet addresses, Plays, Boosting, Sharing, Downloads, and related participation details where the product displays that information.

AUDIOPOOL may share public or platform-visible Artist and Track information with Industry Partners to source, evaluate, or present potential Industry Opportunities. We disclose an Artist's non-public contact information only where the Artist has provided or authorized it for that purpose, requested or accepted consideration for an opportunity, authorized disclosure through Artist Studio or another opportunity flow, or where disclosure is necessary to administer or fulfill an opportunity the Artist has accepted or requested.

Disclosure of Your Information

We may disclose personal information as described below.

1) Service Providers and Vendors

We may disclose information to contractors, service providers, and vendors supporting hosting, infrastructure, authentication, wallets, blockchain data, storage, content delivery, playback, Downloads, analytics, communications, email delivery, customer support, identity verification, compliance, payments, payouts, tax, fraud prevention, security, moderation, and professional services. They are generally required by contract to protect information and use it only for authorized purposes.

2) Other Users and the Public

We may display public profile, Artist, Track, chart, wallet, and participation information through the Services and public blockchain networks as described in this Privacy Policy.

3) Artists

Artists may receive or view participation information connected with their Tracks where that information is displayed through the Services. We do not disclose non-public contact information to Artists merely because a user Played, Boosted, Shared, or Downloaded a Track.

4) Industry Partners, Sponsors, and Fulfillment Providers

We may disclose information to labels, brands, promoters, media companies, platforms, sponsors, festivals, publishers, distributors, agencies, curators, and other Industry Partners where necessary to evaluate, administer, or fulfill an Industry Opportunity, reward, recognition program, Download-related benefit, or campaign. Where non-public contact, identity, payment, or fulfillment information is required, we will provide a program-specific notice or otherwise explain the disclosure where appropriate.

5) Payment, Payout, Tax, and Compliance Providers

We may disclose information to payment processors, payout providers, financial institutions, identity-verification vendors, tax providers, sanctions-screening providers, and similar parties where required for offchain rewards, opportunity fulfillment, legal compliance, fraud prevention, or tax administration.

6) Affiliates and Corporate Transaction Parties

We may disclose information to subsidiaries and affiliates and to potential or actual investors, lenders, buyers, successors, or advisers in connection with financing, due diligence, a merger, acquisition, restructuring, reorganization, dissolution, or sale or transfer of assets, subject to appropriate confidentiality and legal safeguards.

7) Legal, Safety, and Enforcement Disclosures

We may disclose information to comply with law, regulation, legal process, or government requests; enforce our agreements and rules; investigate fraud, rights violations, manipulation, security incidents, or abuse; protect rights, property, safety, or platform integrity; or establish, exercise, or defend legal claims.

8) With Your Direction or Consent

We may disclose information for another purpose that we explain when you provide it, at your direction, or with your consent.

Aggregated and De-identified Information

We may create and use aggregated, statistical, or de-identified information that does not reasonably identify you. We may use and disclose that information for research, analytics, product development, chart and market insights, business operations, and other lawful purposes. We will not attempt to re-identify de-identified information except to test whether our de-identification processes are effective or as otherwise permitted by law.

Onchain Data and Public Blockchain Disclosures

Certain actions, including Boosting, Unboosting, chart snapshots, rewards, Track-linked smart-contract activity, and other blockchain-enabled interactions, may be recorded on public blockchain networks. Records may include wallet addresses, transaction hashes, timestamps, amounts, Track or contract identifiers, and other onchain metadata.

Public blockchain records:

• may be visible globally;
• may be copied and processed by third parties independently of AUDIOPOOL;
• are generally irreversible; and
• may be immutable and impossible for AUDIOPOOL to delete, correct, restrict, or remove.

AUDIOPOOL does not intend to place your legal name, email address, phone number, mailing address, tax information, or identity-verification documents onchain. Do not include sensitive or unnecessary personal information in Artist Content, profile content, metadata, wallet labels, or other fields that may become public or be associated with onchain activity.

Downloads and File Delivery

Where an Artist authorizes a Track for Download, we may process information needed to determine eligibility and deliver the file, including the Track involved, the user account and wallet, required support action, eligibility result, Download date and time, file format, territorial availability, Download count, device or browser information, and security or fraud-prevention signals.

We may use this information to provide the Download, enforce limits and usage terms, investigate unauthorized redistribution or abuse, support Artists, maintain records, and improve Download features. Artists may receive aggregated or platform-visible Download information and, where the Services expressly display it, public participation information. Artists do not receive a downloader's non-public email address or other contact details merely because a Download occurred.

Email and Communication Requirements

A valid, verified, and monitored email address is a condition of creating and maintaining an AUDIOPOOL account.

We may process your email address and communication information to:

• verify and secure your account;
• deliver communications relating to your account, Tracks, Artist Studio, and Downloads;
• notify you of relevant chart positions, chart movement, chart results, and chart highlights;
• notify you of rewards you have earned, may qualify for, or must take action to claim;
• identify, present, administer, and communicate Industry Opportunities;
• facilitate introductions, enquiries, and communications involving Industry Partners;
• provide moderation, rights, fraud-prevention, compliance, legal, and operational notices;
• confirm whether messages have been delivered or have failed;
• investigate delivery problems and maintain account contactability; and
• maintain records showing which notices and communications were sent.

Communication information we may process includes:

• your email address;
• email verification status;
• delivery and bounce records;
• message timestamps;
• communication category;
• objection and suppression records;
• opens and clicks where permitted by applicable law; and
• communications between you, AUDIOPOOL, and relevant Industry Partners.

If your email address is invalid, messages repeatedly fail, or AUDIOPOOL can no longer communicate with you about matters necessary to provide the Services, AUDIOPOOL may restrict, suspend, or close your account.

Essential participation communications cannot be disabled while your account remains active. AUDIOPOOL does not offer an account that is disconnected from communications necessary to provide and administer the Services. If you do not wish to receive essential participation communications, you must close your account. We may continue to process information and send communications that are legally required or necessary to complete account closure, resolve outstanding matters, prevent fraud, maintain suppression or compliance records, or establish, exercise, or defend legal claims.

AUDIOPOOL does not send unrelated promotional emails through the essential participation communications stream. If AUDIOPOOL introduces any separate direct-marketing activity in the future, it will provide any consent, notice, objection, and opt-out mechanisms required by applicable law.

Your Privacy Choices and Rights

Depending on your location and applicable law, you may have rights to:

• be informed about our processing;
• request access to personal information;
• request correction of inaccurate or incomplete information;
• request deletion in certain circumstances;
• request restriction of processing in certain circumstances;
• object to processing based on legitimate interests and object at any time to direct marketing;
• withdraw consent at any time where processing is based on consent;
• receive certain information in a portable format;
• opt out of targeted advertising, sale, sharing, or certain profiling where applicable;
• appeal a decision concerning a privacy request where applicable; and
• lodge a complaint with a data protection or supervisory authority.

You may update certain information and communication preferences through the Services where available. You may also submit a request to support@audiopool.io. We may need to verify your identity and authority before completing a request.

Rights are subject to legal conditions and exceptions. We may retain information where necessary for legal obligations, tax, accounting, fraud prevention, platform integrity, rights enforcement, security, dispute resolution, or legal claims. We may be unable to delete or change public blockchain records or information copied, cached, archived, or redistributed outside our control.

UK and EEA Rights

If you are located in the UK or EEA, you may have the rights described above under the UK GDPR, EU GDPR, and related law. You may object at any time to processing of your personal data for direct marketing, including related profiling. Where you object, we will stop that processing, subject to retaining a suppression record.

You also have the right to lodge a complaint with the supervisory authority in your country or region. We encourage you to contact us first so we can try to address your concern.

U.S. State Privacy Rights

Residents of certain U.S. states may have rights to know, access, correct, delete, or obtain a copy of personal information, and to opt out of certain sales, sharing, targeted advertising, or profiling, subject to the definitions and exceptions in applicable law. You may also have a right not to receive discriminatory treatment for exercising privacy rights and to appeal certain decisions.

AUDIOPOOL does not sell personal information for money. Some uses of analytics, advertising, or partner technologies may be considered a "sale," "sharing," or targeted advertising under certain state laws depending on implementation. Where required, we will provide an applicable opt-out mechanism and honor legally recognized preference signals.

To make a request or appeal, contact support@audiopool.io. Authorized agents may submit requests where permitted by law, subject to verification.

International Data Transfers

AUDIOPOOL is based in the United States and uses providers and partners in multiple countries. Your information may be transferred to and processed in countries whose data protection laws differ from those where you live, including the United States.

Where required by law, we use appropriate safeguards for international transfers, such as adequacy decisions, standard contractual clauses, the UK International Data Transfer Addendum, contractual commitments, security measures, or another lawful transfer mechanism.

Data Retention

We retain personal information for as long as reasonably necessary for the purposes described in this Privacy Policy, including to:

• provide and administer the Services and your account;
• host Artist Content and maintain chart, Download, reward, and participation records;
• administer Industry Opportunities and fulfill programs;
• comply with legal, tax, accounting, regulatory, and contractual obligations;
• prevent fraud, manipulation, unauthorized redistribution, and abuse;
• maintain security, suppression, audit, and integrity records;
• resolve disputes and enforce agreements; and
• establish, exercise, or defend legal claims.
